EmotiKit Terms of Service

This English text is a reference translation provided for convenience. The Korean version is the official document and prevails in the event of any discrepancy.

1. About the Service

  • · EmotiKit (the "Service") is a web service that provides a free library of design assets. You can download assets for free and use extra features such as the Daily Draw.
  • · Signed-in users can spend credits to generate their own private asset set that references the art style of an existing asset (a "custom set"). A custom set is shown only to the user who requested it and does not appear in the public library or the Daily Draw.
  • · The assets the Service provides are AI-generated images. The Service does not guarantee any particular quality or commercial outcome for the assets.
  • · The scope of use for the assets is set out in Section 4. Usage guides and on-screen guidance are provided for convenience only; if they differ from these Terms, these Terms prevail.

2. Accounts and data

  • · Downloading assets does not require signing in; some features, such as the Daily Draw and making custom sets, require signing in.
  • · You can sign in with a Google or Kakao account. When you sign in, information such as your Daily Draw history, custom sets, and credits is linked to and managed under your account.
  • · You can delete your account at any time from the My Account page. On deletion, your profile information is destroyed immediately and data linked to your account (including custom sets) is deleted; any remaining credits are forfeited and are not restored even if you sign up again. Refunds for purchased credits must be requested before deletion, in accordance with the Refund Policy.

3. Paid services and credits

  • · The Service may sell credits (prepaid passes) used for paid features such as generating custom sets. Free credits may be granted on signup. The credit cost, price, and composition of each feature are posted on the Pricing page and may change after prior notice.
  • · Payments are processed through a payment provider (such as Lemon Squeezy, the Merchant of Record), and that provider's terms also apply.
  • · Refund criteria for credits follow the Refund Policy page.
  • · Credits that have already been used are treated as services rendered. If a feature fails to be provided due to a service error, the credits are not deducted, or they are restored.
  • · Because of how AI generation works, custom set results vary each time; where generation completes normally, credits are not restored merely because the style or composition of the result differs from your expectations.

4. Scope of rights to the assets

  • · All assets the Service provides are AI-generated images. Assets may be used for free in personal and commercial projects; redistributing or reselling the asset files themselves is prohibited.
  • · The legal protection of AI-generated works, including copyright, may vary depending on applicable laws and their interpretation. The Service makes assets freely usable on the condition that you follow the scope-of-use guidance, and does not guarantee any exclusive or sole rights to the assets.
  • · Third parties may generate or use identical or similar assets. Using an asset does not guarantee that you acquire any right (such as a trademark or copyright) that excludes others' use.
  • · Using assets for purposes that require exclusive rights, such as trademark registration, brand logos, or exclusive character IP, is not recommended, and the Service is not responsible for problems arising from such use.
  • · You are responsible for judging whether an asset is suitable for your purpose, and you must not use assets to infringe others' rights or to create unlawful content.
  • · You are responsible for use beyond the permitted scope (such as redistributing or reselling asset files, or profiting from doing so) and for any problems or disputes arising from how you use the assets; the Service is not liable for any resulting damages.
  • · A custom set may be used by the user who requested it in personal and commercial projects. However, securing the rights to the subjects you enter (brand names, characters, and so on) is your responsibility, and you are responsible for problems arising from entering others' trademarks or works without authorization.

5. Prohibited conduct

  • · Calling the Service's API in abnormal ways, or sending excessive download or draw requests through automated means
  • · Using the Service to create unlawful content or content that infringes others' rights
  • · Bypassing the Service's security or attempting to access other users' data
  • · Violations may result in restricted access without prior notice.

6. Limitation of liability

  • · The Service is provided "as is." The Service is not responsible for the suspension or change of free features and beta features.
  • · Liability for indirect or incidental damages arising from use of the Service is limited to the extent permitted by applicable law.
  • · Disputes related to paid payments follow the Refund Policy and the payment provider's dispute-resolution procedures.

7. Miscellaneous

  • · These Terms are governed by the laws of the Republic of Korea.
  • · If these Terms change, the changes are posted on this page, and significant changes are announced within the Service.
